Terms of Service
By creating an account or using the Hawk Margin platform, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.
1. About Hawk Margin
Hawk Margin provides a software-as-a-service platform (“the Service”) that gives ecommerce businesses profit intelligence tools, including HawkScan, the Profit Dashboard, Reporting Tools and Agency Tools. The Service is provided by Hawk Margin Ltd, registered in England.
2. Your account
To use the Service, you must create an account. You are responsible for:
- Providing accurate information when registering
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at contact@hawkmargin.com
You must be 18 or over and have the authority to enter into this agreement on behalf of your business.
3. Acceptable use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to process data you do not have the right to use
- Attempt to reverse engineer, copy or reproduce any part of the platform
- Use the Service in any way that could damage, disable or impair its functionality
- Resell or sublicense the Service without our written permission
- Use the Service for any unlawful purpose or in violation of any applicable law
4. Subscriptions and billing
4.1 Plans and pricing
The Service is offered on subscription plans (Starter, Growth, Agency). Current pricing is displayed at hawkmargin.com/pricing. We reserve the right to change pricing with 30 days’ notice.
4.2 Billing
Subscriptions are billed monthly via Stripe. By providing payment details, you authorise Hawk Margin to charge your payment method on a recurring monthly basis.
4.3 Free trial
We offer a free trial period. No credit card is required to start a trial. At the end of the trial period, you will need to subscribe to continue using the Service.
4.4 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.
4.5 Failed payments
If a payment fails, we will notify you and attempt to retry the charge. If payment remains outstanding after 7 days, access to the Service may be suspended until payment is made.
5. Data and integrations
By connecting your store or ad accounts to Hawk Margin, you grant us permission to access and process the data necessary to provide the Service. You retain ownership of your data at all times.
We process your data in accordance with our Privacy Policy. You are responsible for ensuring you have the necessary rights and permissions to share data with Hawk Margin.
Your customers’ data
When you connect your store to Hawk Margin, we process order data that may relate to your end customers (for example, order values, product purchases and refunds). In this context, you are the data controller for your customers’ data and Hawk Margin acts as a data processor on your behalf. You are responsible for ensuring that you have a lawful basis for sharing your customers’ data with us, and that your own privacy policy discloses this processing to your customers. We will process this data only in accordance with your instructions and as necessary to provide the Service.
6. Intellectual property
All intellectual property in the Hawk Margin platform — including HawkScan, the HawkScan Score methodology, software, designs, trademarks and content — is owned by Hawk Margin Ltd. Nothing in these Terms grants you any rights to our intellectual property except the right to use the Service in accordance with these Terms.
7. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Hawk Margin makes no warranties — express or implied — regarding the Service, including its accuracy, reliability, fitness for a particular purpose or uninterrupted availability.
The profit calculations and metrics provided by HawkScan are based on data you provide and data from connected integrations. We cannot guarantee their accuracy and they should not be relied upon as the sole basis for financial decisions. You should always verify profit data with your own accountant or financial advisor.
8. Limitation of liability
To the fullest extent permitted by law, Hawk Margin shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service — including but not limited to loss of profits, loss of data or loss of business opportunity.
Our total liability to you for any claim arising under these Terms shall not exceed the fees you paid to us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Hawk Margin, its directors, employees and agents from any claims, losses, damages or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third party’s rights.
10. Business transfers
In the event that Hawk Margin is acquired, merged with another company, or undergoes a sale of all or part of its assets, your account data and personal information may be transferred to the new owner as part of that transaction. We will notify you by email and via a notice on our website before any such transfer takes place. The new owner will be required to honour the commitments made in these Terms of Service and our Privacy Policy, or obtain your fresh consent where required.
11. Termination
We may suspend or terminate your access to the Service immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.
Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days, subject to our legal retention obligations.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
13. Force majeure
Hawk Margin shall not be liable for any failure or delay in providing the Service where that failure or delay results from circumstances beyond our reasonable control — including but not limited to natural disasters, acts of government, changes to third-party platform APIs (including Google Ads, Meta and other ad platforms), internet outages, power failures, industrial disputes, or other events outside our control. We will notify you as soon as practicable and take reasonable steps to restore the Service.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
